1. Who you are contracting with

Living Language Forge ("the Service") is operated by Venta Belgarum ("we", "us", "our"). These Terms & Conditions ("Terms") form a binding agreement between you and Venta Belgarum. By creating an account, accessing, or using the Service, you agree to these Terms.

2. The Service

Living Language Forge is a web-based platform for designing, organizing, and publishing fictional constructed languages, including AI-assisted generation tools, a Language Bible editor, a lexicon and corpus manager, and related worldbuilding features.

3. Authority and eligibility

If you are using the Service on behalf of an organization, you confirm you have authority to bind that organization. If you use the Service as an individual, you confirm you are of legal age in your jurisdiction to enter into a binding contract.

4. Account and credentials

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must provide accurate information and keep it up to date.

5. Acceptable use

You must not misuse the Service. In particular, you must not:

  • use the Service for any unlawful, fraudulent, or deceptive purpose;
  • send spam, harass other users, or violate any third party's rights;
  • infringe intellectual property, privacy, or publicity rights of any person;
  • introduce malware, attempt to probe, scan, or breach security or authentication measures;
  • scrape, crawl, or harvest data from the Service except as expressly permitted;
  • interfere with or disrupt the integrity or performance of the Service.

6. AI-generated content

The Service includes generative AI features ("AI Tools") used to produce text, vocabulary, grammatical drafts, scenes, and similar linguistic content. By using the AI Tools:

  • You are responsible for your prompts and for how you use the outputs. You must have the rights to any input content you submit.
  • You must not use the AI Tools to generate content that is illegal, violent, sexual content involving minors, hateful, deceptive (including deepfakes), or designed to harass or harm others, nor to attempt to jailbreak, manipulate, or extract underlying model behavior.
  • Outputs may be inaccurate, incomplete, or biased. You are responsible for reviewing outputs and must not rely on them as a substitute for professional advice (legal, medical, financial, or otherwise).
  • We may remove, restrict, refuse, or filter outputs and inputs that we reasonably believe violate these Terms or applicable law, and may suspend or terminate accounts that repeatedly infringe third-party rights.
  • As between you and us, you retain rights in your prompts and in the user-facing outputs you generate, subject to the licenses below and to third-party rights. If a rights-holder believes content on the Service infringes their rights, they may contact us at the address in Section 14 to request review and takedown.

7. Intellectual property

We retain all right, title, and interest in and to the Service, including its software, documentation, design, and branding. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service within the plan you have selected. You may not reverse engineer, resell, redistribute, or circumvent technical limits of the Service.

You retain ownership of the content you create in the Service ("Your Content"). You grant us a limited, worldwide, royalty-free license to host, store, transmit, process, and display Your Content solely as needed to operate and provide the Service to you.

8. Payment, subscriptions, and refunds

Paid plans, credit top-ups, and other purchases are processed by our reseller. See Section 9 for the Merchant of Record disclosure. Payment, billing, taxes, currency conversion, cancellation, and refund mechanics are governed by the Paddle Checkout Buyer Terms and by our Refund Policy.

Subscriptions renew automatically at the end of each billing period until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period. Forge credits granted by a paid plan are consumed by AI actions; specific credit costs are described in the app.

9. Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

10. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time by closing your account. On termination, your right to use the Service ends. We will make Your Content available for export for a reasonable period before deletion, except where retention is required by law.

11. Warranty disclaimer

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that AI outputs will meet your requirements.

12. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to these Terms or the Service will not exceed the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim. We will not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, goodwill, or business opportunity. Nothing in these Terms excludes liability that cannot be excluded under applicable law (including fraud, death, or personal injury caused by negligence).

13. Indemnity

You agree to indemnify and hold harmless Venta Belgarum from and against claims, damages, and expenses arising out of Your Content, your use of the Service in violation of these Terms, or your violation of any law or third-party right.

14. Changes, governing law, and contact

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance.

These Terms are governed by the laws of the jurisdiction in which Venta Belgarum is established, without regard to conflict-of-laws principles. Disputes will be brought before the competent courts of that jurisdiction, except where mandatory consumer law provides otherwise.

Force majeure: neither party is liable for failure to perform due to events beyond reasonable control. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
